Default Forgetting some of the legal stuff.

What happens if you forget to have the legal stuff in place?
I am partnered with someone who is terminally ill and in the last week he went into a coma. Now I am worried about all the legal documents that should have been put in place that I thought were but just found out they are not? Can I lose the house? I was reading how the estate can be taken over by the court. Since we both are on the mortgage, can they do this?
